DISTANCE SALES CONTRACT

This Distance Sales Contract (“Contract”) is entered into between the parties specified below to regulate the sale transaction conducted through the e-commerce platform https://contactturkiye.shop/  (“Site”). The Contract is prepared in accordance with the Law No. 6502 on the Protection of Consumers, the Regulation on Distance Contracts, the Law No. 6698 on the Protection of Personal Data (KVKK), and the EU General Data Protection Regulation (GDPR).

2. Subject of the Contract

This Contract regulates the sale, delivery, and related rights and obligations of the products purchased by the Buyer through the Site. The Contract becomes binding upon the Buyer’s approval of the Preliminary Information Form.

4. Payment Terms

5. Delivery Terms

  • Delivery Restrictions:

    • Delivery times to certain regions (e.g., island regions) may be extended.
  • Delivery Responsibility: The Seller’s delivery obligation is fulfilled when the product is handed over to the shipping company.

6. Right of Withdrawal

  • Withdrawal Period: The Buyer may exercise the right of withdrawal within 14 days from the delivery date (Law No. 6502, Article 48; Regulation, Article 9).
  • Withdrawal Notification: The withdrawal request must be submitted in writing to [returns@contactturkiye.com (mailto:returns@contactturkiye.com)] or via the Withdrawal Form Link (#).
  • Return Process:
    • The product must be returned unused, in its original packaging, and with the invoice.
    • Return shipping costs are covered by the Seller (for returns within Turkey and the EU).
    • The refund is processed within 14 days of the product’s receipt by the Seller, using the Buyer’s original payment method.
  • Withdrawal Exceptions:
    • Opened, used, or unpackaged health supplements (due to hygiene reasons).
    • Products customized for the Buyer.
  • Data Processing: During the return process, the Buyer’s name, address, payment information, and order details are processed. For details, see our Data Protection Notice (#).

7. Processing of Personal Data

The Buyer’s personal data is processed in compliance with KVKK and GDPR during the order process. For detailed information, please review our Data Protection Notice (#).

  • Collected Data:
    • Identity: Name, surname.
    • Contact: Email address, phone number, delivery address.
    • Financial: Payment information (processed solely by payment providers).
    • Shopping: Order history, product preferences (e.g., health supplements).
    • Technical: IP address, cookie data (Cookie Policy (#)).
    • Special Category Data (if applicable): Health supplement preferences (with explicit consent).
  • Processing Purposes and Legal Bases:
    • Order processing, delivery, and payment: Performance of a contract (KVKK Article 5(2)(c), GDPR Article 6(1)(b)).
    • Customer service and return management: Legitimate interests (KVKK Article 5(2)(f), GDPR Article 6(1)(f)).
    • Marketing and personalized advertising: Explicit consent (KVKK Article 5(1), GDPR Article 6(1)(a)).
    • Legal obligations (e.g., tax, consumer protection): Legal obligation (KVKK Article 5(2)(c), GDPR Article 6(1)(c)).
    • Site security and analytics: Legitimate interests or consent (for cookies).
  • Data Sharing:
    • Data is shared with shipping companies (e.g., Yurtiçi Kargo) for delivery, payment providers (e.g., Stripe) for transactions, and third-party analytics/advertising services (e.g., Google Analytics, with consent).
    • Data transfers outside Turkey or the EU (e.g., US servers) are protected by Standard Contractual Clauses (SCC) under GDPR Article 46 and commitments under KVKK Article 9.
  • Retention Period:
    • Order and payment data: Retained for 5 years due to tax regulations.
    • Marketing data: Processed until consent is withdrawn.
    • Technical data: Retained as specified in the Cookie Policy (#).
    • Data is deleted or anonymized when no longer needed.
  • Buyer Rights:
    • KVKK Article 11: Access, rectification, deletion, objection, compensation for damages, complaint to the Personal Data Protection Authority.
    • GDPR Articles 15-22: Access, rectification, deletion (“right to be forgotten”), restriction of processing, data portability, objection to legitimate interests, objection to automated decisions, complaint to a supervisory authority.

8. Warranty and Product Liability

  • Products are covered by a manufacturer’s warranty (2 years). The warranty certificate is provided with the product.
  • Health supplements are not a substitute for a balanced diet. Consult your doctor before use. The Seller is not liable for damages from improper use.
  • The Seller guarantees that products conform to their descriptions. In case of non-conformity, the Buyer may request a return or replacement.

9. Termination of the Contract

  • By the Buyer: The Buyer may terminate the Contract by exercising the right of withdrawal within 14 days.
  • By the Seller: The Seller may cancel the order and terminate the Contract if the Buyer fails to make payment, provides false information, or acts contrary to legal obligations.
  • Consequences of Termination: Upon termination, any paid amount is refunded within the scope of the right of withdrawal.

10. Dispute Resolution

  • Turkey: Disputes are subject to [Istanbul Consumer Arbitration Committees] (up to 150,000 TRY) or [Istanbul Consumer Courts].
  • EU: Buyers may file complaints via the EU Online Dispute Resolution Platform.
  • Data Protection Disputes:

    • 11. Miscellaneous Provisions
  • Health Warning: Health supplements are not intended to diagnose, treat, or prevent diseases. Consult your doctor before use.
  • Liability Limitation: The Seller is not liable for damages from improper use or unforeseen circumstances.
  • Amendments: The Seller reserves the right to update this Contract. Significant changes will be notified to the Buyer via email or the Site.
  • Entire Agreement: This Contract, together with the Preliminary Information Form, constitutes the entire agreement between the parties.

12. Contract Approval

The Buyer declares that they have read and understood this Contract and the Preliminary Information Form (#) by checking the “I Approve the Contract” box on the order page. The approval is recorded in accordance with KVKK and GDPR (date, time, IP address, e.g., “14.05.2025, 14:36, IP: [Buyer’s IP]”).
